TERMS AND CONDITIONS

Scope of application

The terms and conditions set forth in this document shall apply to the relationship between the visitor (hereinafter referred to as “Client”) and Sooz Hotel from the moment the reservation is requested until the end of the accommodation period at the hotel.

In the event of any omissions in the Terms and Conditions, Brazilian law in force shall apply.

Contract conclusion

  1. By requesting a room reservation, the Client makes an accommodation proposal to Sooz Hotel. If there are available rooms, Sooz Hotel will provide the Client with a reservation code.
  2. The Client is informed that room reservations at Sooz Hotel made through third parties (tour operators or online room reservation portals) require the issuance of a different reservation code than the one issued directly by Sooz Hotel, but it is equally valid.
  3. Requests for room reservations made directly to Sooz Hotel or through third parties are not binding and do not obligate Sooz Hotel to enter into a contract with the Client. Sooz Hotel will always have the right to refuse to enter into a contract and provide a room at its sole discretion.
  4. Sooz Hotel only guarantees the availability of a room in the reserved category and not the availability of a specific hotel room.

III. Types of Reservations and Cancellation Policy

  1. At Sooz Collection Hotel, the Client can make two types of reservations: “simple” reservations and “guaranteed” reservations.
  2. A simple reservation consists of reserving a room without the Client making any payment or providing a means of payment in advance.
  3. A guaranteed reservation consists of reserving a room accompanied by the provision, by the Client, of valid and complete credit card information or by the reservation accompanied by proof of bank transfer of the full price of the reserved accommodation.
  4. A simple reservation can be freely canceled by the Client, at no cost, until 7:00 pm on the day of the reservation.
  5. A simple reservation will automatically expire if the Client does not show up at the hotel by 7:00 pm on the day of the reservation. In this case, Sooz Hotel may immediately make the reserved room available to another Client without the Client who made the reservation being entitled to claim any compensation from Sooz Hotel under any circumstances.
  6. A guaranteed reservation can be freely canceled by the Client up to 24 hours prior to check-in date, without any costs being charged, without prejudice to the specific conditions for trade fairs and special events set out in section XVIII.
  7. If the cancellation request of the guaranteed reservation is made outside the stipulated deadline, the Client will be charged the price for the room on that day, and the reservation will be deemed canceled the next day. The same applies if the Client does not show up on the day of the reservation without canceling the reservation in advance.

Arrival and Departure

  1. The Sooz Hotel will provide the Client with a room of the reserved category from the date of arrival or, if the Client has not made a reservation and hires the accommodation at the hotel reception, depending on the category requested and subject to hotel availability, starting at 2 p.m. and, at the latest, from 5 p.m. on the day of entry into the hotel.
  2. Upon arrival at the hotel, the Client must immediately proceed to pay the price due for the room, number of nights of stay, and additional services.
  3. Against the full payment of the price, the Sooz Hotel will provide the Client with an access code to the room that will remain valid during the contracted stay period.
  4. On the date of departure, the Client must vacate the room of persons and belongings and without any damage by 12 p.m. If the room is not vacated by 12 p.m. on the day of departure, compensation corresponding to the price of one night’s stay at the hotel will be immediately charged, having only the right to use the room during that period if the hotel has room availability, otherwise the Client must pay the compensation and leave the room as soon as possible.

Terms of Use

  1. Only the persons indicated in the accommodation reservation will be entitled to use the hotel room.
  2. Clients must treat the hotel room with care and consideration.
  3. The Client must treat other hotel guests with consideration and respect the hotel rules posted therein, if any, which are also part of the accommodation contract.
  4. The Client is not allowed to cook food brought in, either in the hotel room or anywhere else on the hotel premises. 
  5. Children under 14 years of age must be supervised by an adult Client at all times during their stay at the hotel. 
  6. Clients are advised not to keep any money, jewelry, or other valuables outside the safe in their hotel room or in their vehicle.
  7. The Sooz Hotel provides clients with a safe in each hotel room where valuables can be stored.
  8. The Sooz Hotel assumes no responsibility in the event of theft, loss, or deterioration of money, jewelry, or considerable valuables if such events occur in the hotel room or inside vehicles in the parking lot.

VII. Access to the hotel room by the Sooz Hotel

The Sooz Hotel and its personnel will have the right to enter the hotel room, during the Client’s stay, in order to carry out cleaning, repair, and similar work.

VIII. Stay Price and Other Prices

  1. The price of the stay to be paid by the Customer constitutes the consideration for the provision of the use of the hotel room during the period between arrival and departure.
  2. The total price of the stay will be charged per night, regardless of whether the Customer actually used the room or just spent the night.
  3. The applicable rates are the agreed prices or the prices indicated in the Sooz Hotel price list in force on the date of the contract. Sooz Hotel shall have the right to increase or decrease prices if more than four months have elapsed between the date of the Customer’s reservation and the arrival date, or if any taxes, visitor contributions, or other charges are changed or introduced.
  4. The rates and amounts indicated in the terms and accommodation contract are all subject to ISS, unless expressly stated otherwise.

Terms of Payment

  1. The amount of the stay and additional service prices must be paid in advance, at the time the customer arrives at the hotel, regardless of the due date.
  2. If the duration of the customer’s stay is not specified, the price of the stay and additional service prices for each night must be paid in advance by 12 noon.
  3. In the case of stays without a specified departure date, failure to pay the stay and additional service prices as provided in the preceding paragraph shall result in the immediate termination of the contract and shall immediately require the customer to vacate the room and deliver it to Sooz Hotel free of people and belongings and in good condition.
  4. Fees for additional services, within the meaning of paragraph 1, will include charges for parking, breakfast prices, and other charges that are not expressly mentioned in the accommodation contract but are part of the value of the stay.
  5. Sooz accepts payment in Reais, transfers, CE Maestro, Visa Electron, and credit cards: Visa and MasterCard. Other methods of payment will only be allowed in exceptional cases with the consent promptly provided by Sooz Hotel.

Complaints regarding material defects

  1. The Customer must inspect the hotel room immediately upon arrival and report any defects found at the hotel reception.
  2. Any defects that arise during the stay must be reported to the hotel reception as soon as the customer becomes aware of them.
  3. If it is found that there is indeed a defect in the customer’s room, Sooz Hotel has the right to choose between repairing it and relocating the customer to a room that is at least the same category as contracted with the customer.
  4. For the aforementioned purposes, only serious defects that are likely to affect the level of service and quality of Sooz Hotel will be considered, and Sooz Hotel is not obliged to take any action in the case of irrelevant, unreasonable, or complaints related to details that do not conflict with the minimum level of contracted service.
  5. If Sooz Hotel is unable to repair the relevant defect or replace the customer’s room with one of equivalent or superior category, the customer may only terminate the contract and receive the price paid for the room, without any further demand on Sooz Hotel for any reason.

Responsibility on the part of Sooz Hotel

Sooz Hotel will only be responsible for damages or losses incurred by the Customer when such events result from the negligent acts of Sooz Hotel. 

Sooz Hotel assumes no responsibility for the loss of data provided by the Customer in the case of electronic transmission of payment data, being only responsible in case of negligence. 

Sooz Hotel assumes no responsibility for damages or accidents that occur inside the room or any part of the hotel, except in cases where such accidents are due to the negligent acts of MOOV.

Sooz Hotel will not be considered responsible for any delay in the availability of the room, as long as there is a valid reason for the non-availability of the room.

Valid reasons that make it impossible or more difficult to provide the room will be considered, such as strikes, blockades, natural disasters, accidents in the room or hotel.

In case of delay in the availability of the room beyond 7:00 pm on the day of reservation, the Customer may freely terminate the contract without being entitled to demand any compensation from Sooz Hotel for any reason.

Sooz Hotel assumes no responsibility for acts committed by any hotel employee, except when they are in their normal working hours, duly identified and uniformed as an employee of the company.

Sooz Hotel assumes no responsibility and cannot be held liable for non-compliance with irrelevant obligations.

Sooz Hotel cannot be held responsible for any act or omission of any other Customer, even if it is likely to cause damage or harm to another Customer of the hotel. Any and all damages caused to third parties by hotel Customers will be solely their responsibility and completely unrelated to Sooz Hotel.

Sooz Hotel assumes no responsibility for any lost profits or indirect damages, even if resulting from non-compliance with the main obligation.

XII.Notification duty:

In case of theft or property damage, or in case of fire, water damage or other damages to the hotel room, the Customer must immediately inform the hotel staff and do everything possible to help resolve the theft or repair the damage.

XIV. Termination of accommodation contract:

  1. Sooz Hotel has the right to terminate the accommodation contract if the Customer does not pay the price in full and in advance at the time it is due or does not provide the required guarantee. 
  2. The Customer may notify the termination of the accommodation contract during their stay at any time until 7:00 pm, to take effect from 12:00 noon the following day. 
  3. Any contracting party may summarily terminate the accommodation contract for just cause.
  4. Sooz Hotel will have the right to terminate the accommodation contract immediately for just cause if the Customer has any behavior that affects the good coexistence, peace or hygiene of the hotel, namely if during their stay at the hotel, the Customer is under the influence of drugs or alcohol, uses the hotel room for prostitution practices, acts offensively towards hotel staff or other hotel guests, disturbs the peace of other hotel guests, or has made malicious fake reservations in the past and/or damaged or destroyed the hotel or its facilities.

Data protection:

  1. The Customer is informed that their personal data will be stored and processed by Sooz Hotel and made available to affiliated companies of Sooz Hotel and selected service providers, in accordance with the law, for the purpose of executing the contract, for services to the Customer, and for their own advertising campaigns.
  2. The Customer grants Sooz Hotel the right to use affiliated companies and selected service providers to perform data processing and the right to transmit this personal data under this section to companies that allow them to store and process it.
  3. The Customer has the right to object at any time to the use of personal data for advertising purposes, and must therefore notify Sooz Hotel of this intention in writing.
  4. Unless otherwise required by law, the Customer’s personal data must be deleted when the accommodation contract ends and the legal retention periods have expired.

XVI. General provisions:

  1. The Terms and Conditions fully regulate the Customer’s stay at the hotel and the use of the room by the Customer.
  2. No verbal agreement has been reached during the accommodation contract, and any changes to the contract between the parties must necessarily be documented in writing and signed by both parties, unless it is a unilateral declaration, in which case it must be in writing and signed by the issuer.
  3. Sooz Hotel has the right to have third parties fulfill its obligations under the accommodation contract.
  4. The invalidity of one or more of the above provisions does not affect the validity of the remaining provisions. The invalid provision will be replaced by a valid provision that best reflects the commercial and legal intentions of the parties, or if not possible, by the current Brazilian legislation.
